Waiver & Liability Release

Effective since: 2022

This Waiver & Liability Release (“Waiver”) applies to all camps, clinics, training sessions, events, and physical activities organised or delivered by Thomson Hockey, a business operating from the Netherlands.

By participating in any Thomson Hockey activity, you acknowledge that you have read, understood, and agreed to this Waiver.

1. Acknowledgement of Risk

I understand and acknowledge that participation in field hockey training, camps, clinics, fitness activities, and related sporting activities involves inherent risks, including but not limited to:

  • Physical injury (minor or serious)

  • Overexertion

  • Collisions with players, equipment, or surfaces

  • Accidents resulting in illness or injury

I acknowledge that these risks cannot be completely eliminated, even with proper supervision and care.

2. Voluntary Participation

I confirm that my participation (or the participation of the minor for whom I am responsible) is voluntary.

I understand that I am responsible for assessing my own physical condition and ability to safely participate in all activities provided by Thomson Hockey.

3. Medical Fitness

I confirm that:

  • I am physically and medically fit to participate, or

  • I have obtained appropriate medical advice prior to participation

Thomson Hockey does not provide medical advice and does not conduct medical screenings.

I agree to immediately stop participation and seek medical attention if I experience pain, injury, dizziness, or discomfort.

4. Pregnancy Disclaimer

If I am pregnant, I acknowledge that participation in physical training is at my own risk and should only occur following medical approval.

Thomson Hockey accepts no liability for pregnancy-related injury or complications.

5. Assumption of Risk

I knowingly and freely assume all risks, both known and unknown, associated with participation in Thomson Hockey activities, even if arising from the negligence of Thomson Hockey, to the extent permitted by Dutch law.

6. Release of Liability

To the maximum extent permitted under Dutch law, I hereby release, waive, and discharge Thomson Hockey, its owners, employees, contractors, volunteers, and representatives from any and all claims, demands, or causes of action arising from participation in activities, including claims for personal injury, illness, or property damage.

Nothing in this Waiver excludes liability for intent or gross negligence (opzet of grove schuld).

7. Indemnification

I agree to indemnify and hold harmless Thomson Hockey from any claims, damages, or expenses arising from my participation, or from the participation of a minor for whom I am legally responsible, to the extent permitted by law.

8. Responsibility for Equipment & Personal Property

I am responsible for my own equipment and personal belongings.

Thomson Hockey is not responsible for loss, theft, or damage to personal property.

9. Photography & Video Consent

I grant Thomson Hockey permission to take photographs and/or video recordings during activities for promotional, educational, and marketing purposes.

If I do not wish to be photographed or recorded, I understand that I must notify Thomson Hockey in writing prior to participation.

10. Minors

For participants under 18 years of age:

  • This Waiver must be accepted by a parent or legal guardian

  • The parent or guardian confirms they have authority to consent on behalf of the minor

  • The parent or guardian accepts all terms of this Waiver on behalf of the minor

11. Insurance

I understand that Thomson Hockey does not provide personal accident, medical, or travel insurance for participants.

I am responsible for ensuring adequate insurance coverage.

12. Force Majeure

I acknowledge that activities may be altered, postponed, or cancelled due to circumstances beyond reasonable control, including government restrictions, public health emergencies, or weather conditions.

Any such situations are governed by the Refund & Cancellation Policy.

13. Governing Law

This Waiver is governed by Dutch law.

Any disputes shall be submitted to the competent court in the Netherlands, unless mandatory consumer protection law provides otherwise.

14. Acknowledgement & Acceptance

By participating in any Thomson Hockey activity, or by accepting this Waiver during registration or checkout, I confirm that:

  • I have read and understood this Waiver

  • I understand that I am giving up certain legal rights

  • I agree to this Waiver freely and voluntarily
